1. About these Terms

These Terms apply when you use VibeVote or purchase votes. Before payment, review the nominee, category, vote quantity, price, phone number and competition scope shown at checkout.

2. Acceptance and legal capacity

These Terms govern use of VibeVote and each paid vote order. Immediately before requesting an M-Pesa payment prompt, you can review and correct the nominee, category, quantity, price, phone number, and any displayed competition scope. You enter the agreement only when you actively accept the linked legal documents and select “Pay with M-Pesa”.

You must have legal capacity to contract and authority to use the M-Pesa account. A minor may use the paid service only through, or with verifiable consent from, a parent or guardian where Kenyan law permits.

3. Paid voting service

• The review screen separates paid votes, promotional bonus votes, total votes to be credited, unit price and total Kenyan-shilling amount.
• Each deliberately initiated and successfully paid order is a separate purchase. Repeat purchases are permitted unless a displayed competition rule or technical control says otherwise.
• A duplicate provider callback or replay of the same idempotency key does not create a second order or credit the same payment twice.
• Bonus votes are promotional, have no cash value, and may change prospectively. The promotion applied to an order is captured when the order is created.

A vote is credited only after VibeVote verifies a successful payment-provider confirmation. A pending prompt, timeout, cancellation, failed payment, or unverified receipt does not credit votes. The payment status screen is provisional until reconciliation completes.

4. M-Pesa safety and records

VibeVote may send an STK prompt to the number you provide. Confirm the amount and paybill/account information shown by M-Pesa. Enter your M-Pesa PIN only in the official SIM Toolkit or M-Pesa interface. VibeVote will never ask you to type or disclose your PIN on this website, by telephone, message, or email.

After initiation, we retain a durable order and transaction record containing the selection, paid and bonus quantities, price, payment state, timestamps, provider references/receipt where supplied, and the legal-document versions accepted. Keep your M-Pesa message and VibeVote transaction reference for support.

5. Competition integrity

Votes count only within the competition entry, stage, category and scope associated with the order. County, regional and national tallies are separate and do not automatically carry forward. Published results may be provisional while payments, fraud signals, disputes and qualification decisions are reconciled.

We may delay publication, reject unconfirmed votes, investigate suspicious activity, correct demonstrable technical errors, or disqualify an entry under the Competition Rules. We will not arbitrarily remove a confirmed, valid paid vote.

6. Cancellations, reversals and refunds

Nothing here removes a cancellation, refund, chargeback, reversal or other remedy required by applicable law. Because a confirmed vote may be supplied and recorded promptly, a change of mind does not automatically create a refund right after performance has begun. We assess mistaken duplicate charges, provider reversals, failed crediting, material service failure and legally required remedies on their facts.

Request help through Support with the transaction reference and M-Pesa receipt. Never send an M-Pesa PIN. We may verify identity and payment ownership before disclosing or changing a record.

7. Availability and changes

We aim to provide a reliable service but internet, mobile-network, payment-provider and maintenance outages can occur. Where an outage materially affects an order, we will reconcile the transaction and provide the remedy required by law. Competition schedules, prices and promotions may change prospectively; the order-review screen controls the terms of a submitted purchase.

Material legal-document changes apply prospectively from the stated effective date. We store the version accepted for each new paid order and require renewed acceptance at checkout.

8. Acceptable use, content and intellectual property

Do not attempt unauthorized access, interfere with systems, automate abusive voting, evade limits, impersonate another person, misuse payment credentials, or submit unlawful or infringing content. We may preserve evidence and report suspected offences or fraud to competent authorities.

VibeVote software, branding and original content remain owned by their respective rights holders. If you submit content, you grant VibeVote a non-exclusive, worldwide, royalty-free licence to host, reproduce and display it only as needed to operate, promote and archive the relevant competition, subject to privacy law.

9. Liability and indemnity

To the extent permitted by law, neither party is liable for indirect or consequential loss that was not reasonably foreseeable. Any limitation does not apply to fraud, wilful misconduct, gross negligence, death or personal injury caused by negligence, breach of data-protection obligations where liability cannot lawfully be excluded, or any mandatory consumer remedy.

You are responsible for direct loss reasonably caused by your unlawful misuse, infringement, fraud, or breach of these Terms. This is not an unlimited indemnity and does not cover loss caused by the Operator.

10. Privacy, complaints and disputes

Our Privacy Policy explains how personal data is handled and how to exercise data-subject rights.

Raise a complaint through Support with relevant competition and transaction details. Never send your M-Pesa PIN.

These Terms are governed by Kenyan law and disputes are subject to the competent courts of Kenya, without preventing you from using any regulator, statutory complaint process, alternative dispute resolution, or court available under applicable law.
